Terms of service
Last updated: 18 October 2026
These Terms of service govern access to and use of UptimeAnchor, a service for monitoring the availability of websites, APIs and infrastructure provided by [Company name], registered office at [Address], VAT no. [00000000000] (“UptimeAnchor” or “we”). By creating an account you accept these Terms in full.
1.The service
UptimeAnchor lets you run periodic checks on resources you specify (URLs, hosts, ports, DNS records, domains, certificates and scheduled jobs via heartbeats), receive notifications when something fails, publish status pages and access data through the dashboard and API.
The features and limits available depend on the plan you subscribe to, as described on the Pricing page.
2.Account and security
- To use the service you must be at least 18 years old and provide accurate, up-to-date information.
- You are responsible for keeping your credentials and API keys confidential and for all activity carried out with your account.
- We recommend enabling two-factor authentication and giving team members only the permissions they need.
- You must notify us promptly of any unauthorised access.
3.Acceptable use
You may only monitor resources you own or for which you have the owner's permission. In particular, you may not:
- use UptimeAnchor for denial-of-service attacks, unauthorised scanning or any activity that overloads third-party systems;
- configure intervals, payloads or requests intended to circumvent technical or plan limits;
- publish unlawful, misleading or infringing content on status pages;
- resell or make the service available to third parties beyond what your plan allows.
In case of breach we may suspend the affected monitors or the account, without notice where necessary to protect third parties or the infrastructure.
4.Plans, prices and payments
- The Free plan is free of charge and has no expiry, within the limits shown on the Pricing page.
- Paid plans renew automatically at the end of each monthly or yearly period unless cancelled.
- Payments are processed by Stripe; prices are in euros and, unless stated otherwise, exclude VAT.
- On upgrade the difference is charged pro rata; downgrades take effect from the next period.
- Amounts already paid are non-refundable, except as required by law or otherwise agreed in writing.
- We may change prices with at least 30 days' notice; the change applies from the next renewal.
5.Service availability
We are committed to keeping UptimeAnchor available and reliable, with redundant infrastructure and probes in multiple regions. However, the service is provided “as is” and we cannot guarantee that it will be free of interruptions or errors, or that every failure of the monitored resources will be detected or notified.
Delivery of notifications by SMS, phone call, email and third-party services also depends on external providers. Specific service levels (SLAs) apply only if agreed in writing, usually on the Enterprise plan.
6.Customer data and content
The data you enter into the service (monitor configurations, contacts, status page content) remains yours. You grant us the right to process it to the extent necessary to provide the service. For third-party personal data processed on your behalf, such as status page subscribers, we act as a processor under Article 28 GDPR, in accordance with the data processing agreement available on request.
7.Intellectual property
The software, the UptimeAnchor brand, the design and the documentation belong to [Company name] or its licensors. We grant you a limited, non-exclusive, non-transferable licence to use the service for the duration of your subscription.
8.Limitation of liability
To the extent permitted by law, UptimeAnchor is not liable for indirect damages, loss of profits, data or business opportunities arising from the use or failure of the service. Total liability is limited to the amounts paid by the customer in the 12 months preceding the event. This does not affect liability for wilful misconduct or gross negligence or any other limits that cannot be excluded by law.
9.Term, cancellation and deletion
- You can cancel your subscription at any time from the dashboard: the plan remains active until the end of the paid period.
- You can delete your account and all of the organisation's data from the settings.
- We may terminate with 30 days' notice, or with immediate effect in case of serious breach of these Terms.
10.Changes to the Terms
We may update these Terms for legal, technical or commercial reasons. Material changes will be communicated by email or through the dashboard at least 30 days in advance. By continuing to use the service after they take effect you accept the new version.
11.Governing law and jurisdiction
These Terms are governed by Italian law. For disputes with business customers, the courts of [City] have exclusive jurisdiction. For consumers, the jurisdiction of the court where the consumer resides or is domiciled is unaffected.
